These Terms & Conditions govern your use of this website and its content, including blog articles, free resources and downloadable materials, as well as the purchase and use of digital products, personalized itinerary planning and guided hiking services offered through the website.

I operate as an individual self-employed professional registered in Portugal.
By accessing or using this website, blog content or free resources, including the free Madeira mini-guide, you agree to the provisions of these Terms that apply to website content and free resources.
By purchasing a digital product or personalized itinerary service, or by booking a guided hiking tour, you also agree to the provisions applicable to that product or service.
Where mandatory consumer-protection law provides rights that cannot legally be excluded or limited, those rights take precedence over these Terms.
1. Website and Blog Information
I provide travel information about Madeira, including information about hiking trails, attractions, restaurants, accommodation, transport, activities and other travel-related topics.
I make reasonable efforts to provide useful and accurate information based on my own experience and information reasonably available at the time of publication or update.
However, Madeira is a changing destination. Trail access, prices, opening hours, booking requirements, public transport, road access, regulations, businesses and other information can change without notice.
Website and blog content should therefore be treated as general travel information and personal recommendations rather than a guarantee that information will remain current at the time of your visit.
For hiking and outdoor activities in particular, descriptions or recommendations of hiking routes and other outdoor activities do not constitute an assessment that an activity is safe or suitable for a particular individual. Unless you have specifically booked a guided activity with me, you undertake any activity described on this website independently and at your own responsibility. Additionally, you are responsible for checking current weather conditions, official warnings, trail closures, access restrictions and other relevant information before setting out.
2. Free Resources and Mini-Guide
I may provide free downloadable resources, including a free Madeira mini-guide.
Where a free resource is offered in exchange for joining my email list, this will be stated on the relevant signup form.
By requesting the free mini-guide through such a form, you also agree to receive my newsletter and related travel content in accordance with the consent presented when you subscribe.
You can unsubscribe from marketing emails at any time using the unsubscribe link included in each email.
Free guides and resources are provided for your personal, non-commercial use only.
You may not reproduce, redistribute, resell, upload, publicly share or otherwise make substantial portions of these materials available to third parties without my prior permission.
Information in free resources reflects information reasonably available when the material was prepared or updated. You should verify time-sensitive information before relying on it during your trip.
3. Prices and Payment
Prices displayed on the website are stated in euros unless otherwise indicated.
Available payment methods may include Stripe, Apple Pay, Google Pay or other payment methods displayed during checkout.
For online purchases, an order is considered completed once payment has been successfully processed and the order has been confirmed.
For guided hiking tours where payment after the tour has expressly been agreed, you remain responsible for paying the agreed tour price in accordance with the booking and cancellation provisions below.
4. Paid Digital Travel Guides
I currently offer digital travel products including the Ultimate Madeira Reiseführer und Madeira PR Trails Wanderführer.
4.1 Delivery
Paid digital guides are delivered electronically following successful payment through the website.
Download access is normally available for 30 days.
If you legitimately purchased a guide and subsequently lose access after the download period has expired, you may contact me. I will generally restore access where I can verify the original purchase.
4.2 Personal-use licence
Your purchase gives you a personal, non-exclusive, non-transferable licence to use the guide for your own private travel-planning purposes.
You may not reproduce, redistribute, resell, upload, publicly share or otherwise make the guide or substantial portions of it available to third parties without my prior written permission.
All applicable intellectual-property rights remain with me unless otherwise stated.
4.3 Accuracy and updates
Each guide reflects information reasonably available at the time indicated in the guide.
Trail conditions, closures, prices, booking systems, opening hours, businesses, regulations and other travel information may subsequently change.
I do not guarantee that every piece of information will remain current after publication.
You remain responsible for checking current official information, particularly before hiking or undertaking outdoor activities.
4.4 Withdrawal rights for digital content
Paid digital guides are intended to be supplied immediately after purchase.
Where required by applicable consumer law, immediate supply will begin only after you have expressly consented to supply beginning during the statutory withdrawal period and acknowledged the resulting effect on your right of withdrawal.
Where the legal requirements for immediate supply of digital content have been satisfied, your statutory withdrawal right may cease once supply of the digital content begins.
This does not affect any mandatory rights you may have where digital content is defective or does not conform to the contract.
If you purchase a guide accidentally, are charged more than once, or encounter a problem with delivery, please contact me at contact@your-madeira.com.
5. Personalized Itinerary Planning
I offer personalized, hiking-focused itinerary-planning services for trips to Madeira.
Available packages, trip lengths, prices and inclusions are shown on the relevant product page at the time of purchase.
5.1 What’s included
Unless otherwise stated on the product page, the personalized itinerary service includes:
- a 30-minute personal planning call;
- a personalized day-by-day Madeira itinerary;
- hiking recommendations based on your experience, fitness and preferences;
- relevant sightseeing, viewpoint, beach and rest-day recommendations;
- restaurant and other local recommendations;
- bad-weather alternatives where appropriate;
- practical information relating to locations, transport, driving and parking;
- a personalized digital itinerary; and
- an approximately 20-minute walkthrough call after delivery.
A revision round is not included unless expressly stated otherwise.
5.2 Trip length
The package you purchase is based on the total number of calendar days you are on Madeira, including your arrival and departure days.
Arrival and departure days remain part of the itinerary. Depending on your flight times, I may include appropriate activities, airport information and suggestions for making the most of those days.
5.3 Information you provide
I create your itinerary based on the information you provide through the preliminary form and our planning call.
You are responsible for providing accurate and relevant information concerning your:
- travel dates;
- group;
- accommodation arrangements;
- transport arrangements;
- hiking experience and fitness;
- relevant limitations;
- interests and preferences; and
- existing bookings or fixed plans.
Please raise any important preferences or requirements before or during the planning call.
Material changes requested after the planning call are not included in the purchased service.
If your travel dates, accommodation, group composition, transport arrangements or other significant circumstances change after the planning call, additional planning may require an additional service or fee.
5.4 Delivery
I will normally deliver your personalized itinerary within 5 business days after the planning call, unless we expressly agree to a different timeframe.
Once the itinerary is ready, you will receive access to your digital itinerary and we will arrange a short walkthrough call so I can explain the plan and answer questions.
5.5 Access to your itinerary
Your digital itinerary will normally remain accessible until 7 days after the scheduled end of your trip.
You may save or download available content for your personal use. Where appropriate, I can also provide the itinerary in PDF format.
5.6 Planning and recommendations only
The itinerary service is a travel-planning and recommendation service.
I do not make accommodation, restaurant, rental-car, activity or other third-party reservations on your behalf as part of this service.
I may recommend accommodation areas, individual accommodation providers, restaurants, activities, transport providers and other businesses.
You remain responsible for making your own bookings, checking availability and prices, and agreeing to the applicable third party’s terms.
5.7 Cancellation and withdrawal
Under my standard commercial cancellation policy, you may cancel the personalized itinerary service for a full refund before the planning call takes place.
Once the planning call has taken place, I begin personalized work based on your individual requirements and refunds are therefore not normally offered under my standard cancellation policy.
If you request that I begin providing the service during an applicable statutory withdrawal period, I may ask you to expressly request that performance begin before that period expires.
Nothing in this commercial cancellation policy limits mandatory consumer rights.
Where applicable law permits you to exercise a statutory withdrawal right after you have expressly requested that the service begin during the withdrawal period, you may be required to pay an amount proportionate to the service already provided before you informed me of your withdrawal.
6. Guided Hiking Tours
I provide privately guided hiking tours on Madeira for groups of up to five participants, subject to availability and suitability.
I operate my guided activities under my applicable Portuguese tourism registration and maintain the insurance required for the activities I provide.
6.1 Booking
You can submit a hiking-tour inquiry through the website.
As part of the inquiry, I may ask for information concerning the participants, hiking experience, fitness and relevant health or physical considerations.
Submitting an inquiry does not automatically guarantee a booking.
A tour is confirmed once I have accepted the request and confirmed the agreed date, route or tour and other relevant arrangements.
You must accept the applicable Terms & Conditions when submitting your booking inquiry.
6.2 Participant information
You must provide complete and accurate information that may reasonably affect safe participation in the selected hike.
Hiking involves physical exertion and inherent outdoor risks.
You are responsible for considering whether the activity is appropriate for your abilities and circumstances and for following reasonable safety instructions during the tour.
I maintain applicable liability and accident insurance for my guided activities. I nevertheless recommend that visitors to Madeira also maintain appropriate personal travel insurance for their trip.
6.3 Participants under 18
Participants under the age of 18 must be accompanied by a parent or legal guardian, or by another responsible adult appropriately authorized to accompany them.
There is no general minimum age for all tours. Suitability depends on the individual participant and the characteristics of the selected hike.
6.4 Safety and suitability
Safety takes priority over completing a particular route.
I reserve the right to refuse participation, modify a route or discontinue a participant’s involvement where I reasonably consider this necessary for safety.
This may include situations where a participant:
- appears unable to safely complete the planned route;
- has provided materially inaccurate information regarding their experience, fitness or relevant circumstances;
- arrives without appropriate footwear, clothing, water or essential equipment;
- refuses to follow reasonable safety instructions;
- behaves dangerously; or
- creates an unreasonable risk for themselves or others.
Any refund in such circumstances will depend on the individual circumstances and applicable mandatory law.
6.5 Weather, trail closures and changing conditions
Madeira’s mountain weather and trail conditions can change rapidly.
I may change, shorten, postpone or cancel a route where reasonably necessary because of weather, trail closures, official warnings, fire risk, rockfall risk or other safety considerations.
If I cancel a tour before it begins and we cannot agree on a suitable alternative or rescheduled date, I will refund amounts already paid for that tour.
If conditions were suitable when the tour began but subsequently change and I reasonably determine that the route needs to be altered, shortened or discontinued for safety reasons, the agreed tour price remains payable, subject to mandatory consumer rights.
6.6 Customer cancellations
You may cancel a guided hiking tour at least 24 hours before the agreed starting time for a full refund of amounts already paid.
Cancellations made less than 24 hours before the tour are non-refundable under my standard cancellation policy.
Where possible, I may offer you the opportunity to reschedule instead. Rescheduling is subject to my availability and is not guaranteed.
6.7 Late arrival and no-shows
Please arrive at the agreed meeting location on time.
I will normally wait for up to 30 minutes after the agreed starting time.
A late arrival may require the planned route to be shortened or changed where necessary for timing or safety.
If you fail to attend your confirmed tour without cancelling within the required timeframe, the agreed tour price remains due.
Where payment has not already been collected, I may send you an electronic payment request for the amount due.
6.8 Transport
Transport to and from the hiking location is not included unless I expressly agree otherwise.
You are responsible for reaching the agreed meeting location.
6.9 Photography and video
I may take general photographs or videos of landscapes, trails and surroundings during guided activities.
I will not use identifiable photographs or videos of you for social media, advertising or other promotional purposes without first obtaining your permission.
7. Hiking, Outdoor Activities and Personal Responsibility
Hiking and other outdoor activities described or recommended on this website, in blog articles, free resources, digital travel guides and personalized itineraries involve inherent risks.
These risks may include, among others, uneven or slippery terrain, steep or exposed sections, falls, rockfall, rapidly changing weather, heat, cold, strong winds, reduced visibility, road conditions, ocean conditions and other natural or environmental hazards.
7.1 Self-guided activities and recommendations
Unless you have specifically booked a guided hiking tour with me, information about hikes, walks, swimming locations, viewpoints, outdoor activities and other experiences is provided for travel-planning and informational purposes only.
A recommendation does not mean that I have assessed an activity as safe or suitable for you personally.
You are responsible for deciding whether to undertake a recommended activity and for assessing your own fitness, experience, health, equipment and ability in relation to the activity and the conditions at the time.
You are also responsible for checking current weather forecasts, official warnings, trail status, closures, access restrictions and other relevant current information before participating.
Conditions may change after a blog post, guide or personalized itinerary has been prepared, and past personal experience of a route or activity does not guarantee its present or future condition.
7.2 Risks and injuries
By choosing to undertake a self-guided hike, outdoor activity or other experience described or recommended through my website, blog, free resources, digital guides or personalized itineraries, you acknowledge that such activities may involve risks of accident, injury, illness, property damage or other loss.
To the fullest extent permitted by applicable law, I am not responsible for injury, accident, illness, property damage or other loss resulting from your independent participation in a self-guided activity recommended or described in these materials, including where circumstances or conditions have changed since the recommendation was prepared.
You remain responsible for your own decisions, preparation, equipment and conduct when undertaking self-guided activities.
7.3 Guided hiking tours
Where you have booked a guided hiking tour directly with me, the provisions of Section 6 concerning guided hiking tours apply.
During a guided tour, you must follow reasonable safety instructions, use appropriate equipment and inform me accurately of information relevant to your safe participation.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
8. Third-Party Recommendations and External Services
My website, free resources, digital guides and personalized itineraries may recommend or link to third-party businesses and services, including accommodation providers, restaurants, rental-car companies, activity operators and other tourism providers.
Unless expressly stated otherwise, these businesses operate independently from me.
I do not control their availability, prices, terms, performance or services.
Where you make a booking or purchase directly from a third party, the resulting contract is between you and that provider and is subject to that provider’s own terms.
9. Affiliate Relationships and Commercial Partnerships
Some recommendations may involve a commercial relationship.
I may receive a commission when you make a booking or purchase from certain businesses using a discount code, referral link or other referral mechanism associated with me.
I may also receive complimentary or discounted experiences, products or services from businesses in connection with content or collaborations.
Where relevant, commercial and affiliate relationships will be disclosed.
Receiving a commission, free experience or other benefit does not guarantee positive coverage or a recommendation.
Where appropriate, affiliate recommendations included in personalized itineraries will also be identified.
10. Website Comments
You may be able to leave comments on certain blog posts.
Comments are manually moderated before publication.
If I approve your comment, the comment and the name or username you supplied may become publicly visible.
I reserve the right not to publish or to remove comments that are unlawful, abusive, discriminatory, spam, promotional, irrelevant or otherwise inappropriate.
11. Intellectual Property
Unless otherwise stated, the original text, photographs, graphics, downloadable resources, travel guides, personalized itinerary content and other original material provided through the website and my services are owned by me and protected by applicable intellectual-property law.
You may use website content and purchased or free resources for your personal, non-commercial purposes.
You may not commercially reproduce, republish, redistribute, resell or systematically copy my content without my prior written permission.
12. Liability
I provide my content and services with reasonable care and based on information reasonably available to me at the relevant time.
Travel and outdoor conditions can change, and many aspects of a trip are outside my control.
To the extent permitted by law, I am not responsible for losses resulting solely from circumstances outside my reasonable control, including sudden weather changes, official closures, transport disruption, third-party failures or a user’s failure to follow current official information or reasonable safety instructions.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, nor does it restrict mandatory consumer rights.
